You can use Utell.tv if you meet the age rules.
You must be at least 16 to use interactive features. You must be at least 18 to buy Credits, submit Promoted Content, or act for a business.

Your content is yours; you give Utell.tv permission to run the platform.
You keep ownership of your content. By posting, you let Utell.tv host, display, share, adapt, recommend, and promote it as needed to operate and improve Utell.tv.

Keep it safe, lawful, and respectful.
Do not post harmful, illegal, deceptive, infringing, exploitative, or privacy-violating content. You must have permission from people and rights holders whose material appears in your content.

Credits and Coins are for Utell.tv only.
Credits may be purchased and Coins may be earned. They are not cash, cannot be sold or transferred, and may be corrected or reversed if there is an error, fraud, abuse, or a payment problem.

We use technology to operate the service.
Utell.tv may use automated systems, including AI, to organize, recommend, analyze, moderate, and improve content and platform features.

We can moderate and enforce the rules.
Utell.tv may remove content, limit features, or suspend accounts to protect users, prevent fraud, enforce the Terms, and comply with law. Appeals may be available through the Platform.

Copyright and intimate-content reports have a clear path.
Copyright owners may send a DMCA notice to the designated agent. Utell.tv prohibits nonconsensual intimate content and sexual deepfakes and provides a removal-reporting process.

Disputes are handled individually.
Most disputes go through individual arbitration, with a 30-day opt-out option. The Terms also limit liability to the extent the law allows.
These Terms & Conditions govern your access to and use of Utell.tv's websites, applications, video experiences, interactive games, content, payment features, and related services (the "Platform"). The Platform is operated by Utell.tv, LLC ("Utell.tv," "we," "us," or "our"). By using the Platform, you agree to these Terms and our Privacy Policy.

1. Eligibility and Accounts
You must be at least 16 to use interactive Platform features. If you are 16 or 17, you may use the Platform only with permission from a parent or legal guardian. You must be at least 18, or the age of legal majority where you live if higher, to purchase Credits, submit Promoted Content, or act for a business. You are responsible for your account, login credentials, and activity through your account.

2. Community Rules and Your Content
Do not post or distribute unlawful, infringing, deceptive, exploitative, threatening, hateful, sexually exploitative, or otherwise harmful content. Do not impersonate others, violate privacy or publicity rights, manipulate views or rewards, interfere with security, evade restrictions, or use Credits or Coins fraudulently.
You retain ownership of content you submit. You grant Utell.tv a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, distribute, promote, and make available that content as needed to operate, improve, and promote the Platform. You represent that you have all rights, permissions, releases, and consents needed to submit it.

3. Credits, Coins, and Payments
Credits and Coins are virtual, in-platform units. They are not cash, bank deposits, stored-value accounts, securities, or property; have no monetary value outside the Platform; and may not be sold, transferred, gifted, exchanged, or redeemed for cash except where Utell.tv expressly permits or applicable law requires. Credits may be offered for purchase and Coins may be earned through eligible activities. Rules, rates, maximums, and uses may change as permitted by law.
Payments may be processed by Stripe or another designated processor. Except where required by law or expressly stated at checkout, Credit purchases are final and non-refundable. We may correct errors, reverse transactions, adjust balances, or cancel Credits or Coins reasonably believed to have been obtained through error, fraud, abuse, a Terms violation, or a technical issue.

4. Moderation, Appeals, and Automated Systems
We may use automated tools, including artificial intelligence, to organize, recommend, analyze, moderate, and improve content and Platform features. We may remove content, limit features, suspend or terminate accounts, or take other action to enforce these Terms, protect users, prevent fraud, comply with law, or operate the Platform. Where available, you may use the Platform appeal process to request review of a moderation decision.

5. Copyright and DMCA
Utell.tv respects intellectual-property rights and may remove or disable access to material alleged to infringe copyright. We may terminate repeat infringers in appropriate circumstances. A copyright owner or authorized agent may submit a DMCA notice containing the information required by 17 U.S.C. § 512(c)(3), including a signature, identification of the copyrighted work and allegedly infringing material, contact information, good-faith and accuracy statements, and authority to act for the owner.

If we remove material in response to a compliant notice, we may notify the uploader. The uploader may submit a counter-notice as permitted by law. Knowingly making a material misrepresentation in a DMCA notice or counter-notice may result in liability.

6. Nonconsensual Intimate Content and Deepfakes
Utell.tv prohibits the publication or threatened publication of nonconsensual intimate visual depictions, including authentic images or videos and realistic digital forgeries or sexual deepfakes. An identifiable person depicted in such content, or an authorized representative, may request removal through the Platform reporting tools or by emailing support@utell.tv with the subject line "Intimate Content Removal Request."
Where the federal TAKE IT DOWN Act applies, Utell.tv will remove a validly reported depiction as soon as reasonably possible and no later than 48 hours after receiving the request, make reasonable efforts to identify and remove known identical copies within the same period, and provide confirmation or status information to the requester.

7. Intellectual Property, Third Parties, and Platform Changes
Utell.tv and its licensors own the Platform and its associated intellectual property. No rights are granted except the limited right to use the Platform under these Terms. The Platform may include third-party services, links, or user content; we are not responsible for them. We may modify, suspend, discontinue, or test any part of the Platform at any time as permitted by law.

8. Disclaimers, Liability, and Indemnity
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, UTELL.TV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, UTELL.TV WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO UTELL.TV FOR THE APPLICABLE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.
You will defend, indemnify, and hold harmless Utell.tv and its affiliates, officers, employees, and agents from claims arising from your content, use of the Platform, violation of these Terms, or violation of another person's rights.

9. Disputes and Arbitration
Before starting arbitration or litigation, send a written Notice of Dispute to support@utell.tv with the subject line "Notice of Dispute" and allow 30 days for informal resolution. Except for eligible small-claims matters, certain injunctive relief, and claims that applicable law does not permit to be arbitrated, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Utell.tv waive jury trials and class, collective, coordinated, mass, and representative actions to the extent permitted by law.
You may opt out of arbitration within 30 days after first accepting these Terms, or within 30 days after the effective date of revised Terms for an existing user, by emailing support@utell.tv with the subject line "Arbitration Opt-Out" and including your name, account email or username, mailing address, and a clear opt-out statement.

10. Governing Law, Changes, and Contact
Arizona law governs these Terms and disputes not governed by the Federal Arbitration Act, except where mandatory law requires otherwise. For disputes not subject to arbitration or small claims, the parties consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, unless applicable law requires another forum.
We may update these Terms to reflect legal, safety, security, payment, product, or operational changes and will provide notice of material changes through the Platform, email, or another reasonable method. Questions, legal notices, payment-support requests, rights reports, accessibility questions, and privacy requests may be sent to support@utell.tv.
